Terms of Use

These terms apply to the Earstep app and this website, provided by the publisher of Earstep ("we", "us"). By using the app you agree to them. If you do not agree, please do not use the app.
1. What the app is
Earstep is an ear-training app: it plays sounds and asks you to name them. We work hard to keep the sounds, names and explanations accurate, but we do not guarantee that the content is complete or error-free, or that you will reach any particular level of skill. The perfect pitch track trains naming notes without a reference note; it does not promise that you will develop perfect pitch. If you spot a mistake, please tell us at support@earstep.com.
2. Your license
We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, for your own non-commercial practice. You may not copy, resell, redistribute or reverse engineer the app, or use automated means to extract its content. The piano samples come from Salamander Grand Piano by Alexander Holm, used under the Creative Commons Attribution 3.0 Unported (CC BY 3.0) license (see Credits); our levels, explanations, figures, design and code are ours.
If you downloaded the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, the Google Play Terms of Service also apply. If these terms conflict with the store's terms about the store's role, the store's terms apply.
3. Purchases
Part of the app is free: a set of levels in every track, with no time limit and no card needed. Earstep Pro is optional and opens every level. You can buy it as a yearly subscription or as a one-time lifetime purchase.
The yearly subscription renews automatically at the price shown in the app until you cancel. If it starts with a free trial, you are charged when the trial ends unless you cancel at least 24 hours before. After that, payment is charged to your Apple or Google account at each renewal unless auto-renew is turned off at least 24 hours before the end of the current year. You can manage or cancel it at any time in your App Store or Google Play subscription settings. The lifetime purchase is a single payment and does not renew. Payment is handled by Apple or Google, and refunds are governed by their policies. You can restore a purchase on another device signed in to the same Apple or Google account with Restore purchases.
Prices are shown in the app before you buy and may vary by country. We may add, change or remove content over time; we will not take away content included in Earstep Pro while you have paid for it, except where required by law or to correct errors.
4. Accounts
An account is optional. You can sign in with a code sent to your email, with Sign in with Apple, or with Sign in with Google. Keep access to your email address and those accounts secure. You are responsible for activity on your account. You can delete your account at any time in the app, as described in our Privacy Policy.
5. Acceptable use
Do not misuse the app or its servers: no attempts to access other people's data, disrupt the service, or get around security or purchase checks. We may suspend accounts that do.
6. Disclaimers
To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow these exclusions, so they may not all apply to you.
7. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost time or lost opportunities, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory local law.
8. Changes and termination
We may update these terms. If a change is material, we will update the effective date and, for account holders, send notice by email before it takes effect. You can stop using the app at any time. We may stop offering the app, in which case the app and content already on your device keep working as they are.
9. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules, except where the law of your country of residence requires otherwise.
